Cook with Miguel – Diabetes YOUnited Experience (Competition).
1. Promoter & these terms and conditions
(a) Information on how to enter and the Prize form part of these terms and conditions. By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid.
(b) The Promoter is Diabetes Australia (ABN 47 008 528 461) of Ground Floor 19-23 Moore Street, Turner ACT 2612. To contact the Promoter, please contact younited@diabetesaustralia.com.au OR telephone our customer service line on 1800 177 055.
2. Starting and Closing Date
The competition commences at 12:00 AM AEST on Monday, 15 September 2025, and closes at 11:59 PM AEST on Sunday, 28 September 2025 (Competition Period).
3. Eligibility to enter
(a) Entry is open to residents of Australia who are aged 18 years or over (Eligible Entrants).
(b) Directors, management, employees and their immediate families, of the Promoter, retailers, suppliers, associated entities and agencies associated with this competition are ineligible to enter.
4. How to enter
(a) To enter, Eligible Entrants must, during the Competition Period:
(i) join by becoming a new member as a YOUnited Plus or YOUnited Legacy Member; or
(ii) upgrade their existing membership from a YOUnited Essential Membership to a YOUnited Plus or YOUnited Legacy Membership; or
(iii) be an existing YOUnited Plus or YOUnited Legacy Member; and
(iv) comply with clause 4(b).
(b) Entry is upon the Eligible Entrant complying with clause 4(a) and answering the following question in 25 words or less:
"In 25 words or less, tell us what you are excited about in joining Diabetes YOUnited PLUS."
Entries will be judged by the Promoter based on creativity, originality and relevance. Entries are deemed received at the time of receipt by Diabetes Australia, not at the time of transmission by the Eligible Entrant.
(c) Only one entry per Eligible Entrant is permitted.
(d) No costs of entry are covered, and entrants will not be reimbursed.
5. Prize
(a) The prize is five (5) winners to attend an exclusive cooking experience with Miguel Maestre in Sydney on 10 October 2025, including travel and accommodation if the Winner resides in a State or Territory of Australia other than New South Wales on the basis specified in clause 5(b). Total prize pool value: approx. $5,000 AUD (Prize) inclusive of GST and exclusive of travel and accommodation costs.
(b) The Promoter will arrange at its cost for 1 economy return flight (with the Winner flying to Sydney the day before the event and flying back to their State or Territory the day of the event once the event has concluded plus any taxi costs to and from the airport to the hotel and event) and accommodation for the night prior to the event, , will be included in the Prize for Winners that reside in a State or Territory of Australia other than New South Wales . All other expenses not expressly referred to in clause 5(a) and 5(b) will be at the Winner’s cost. The Promoter will not be liable for any failure to meet travel schedules or for cancellations. No cash or alternative prize will be awarded if a Winner or their companion cancels for any reason. The Prize is not transferable, exchangeable, or redeemable for cash.
(c) To the maximum extent permitted by law, the Promoter is not responsible or liable for any loss, damage or injury suffered by any Winner arising from, or in connection with the Prize, the event or the conduct of the Prize supplier.
(d) The Promoter is not liable for any loss, damage or injury suffered as a result of the Winner accepting or using the Prize (or both), except for any liability that cannot be excluded by law.
(e) Eligible Entrants acknowledge that use of, or participation in, the Prize carries inherent risk. Eligible Entrants acknowledge that use of the Prize may be dangerous and if they (and any other person(s) sharing the Prize with the Winner) choose to participate in the Prize they do so at their own risk to the maximum extent permitted by law. Use of, or participation in, the Prize may be subject to obtaining medical clearance. The Promoter or Prize supplier may require the Winner and their companion to sign an agreement releasing the Prize supplier (or both) from all liability arising from the Winner’s or their companion’s use of the Prize to the maximum extent permitted by law.
6. Draw date and time
(a) The draw will take place on Monday, 28 September 2025, at 29 Finchley St, Milton QLD 4064 (Draw Date).
(b) All valid entries will be included in the draw. The five (5) winners will be drawn from the valid entries and based on the best answers having regard to the criteria specified in clause 4(b) (Winners).
(c) The Prize will be announced and distributed in accordance with clause 7. Winning is not contingent on being present at the draw.
7. Notification & distribution
(a) The Winners will be notified on the Draw Date via phone and email.
(b) The Winner’s name will be published on the Promoter’s membership forum.
(c) The Promoter will make reasonable efforts to contact the Winner. If the Winner cannot be identified, located, rejects the Prize or does not respond to the Promoter or accept within 3 business days of the Draw Date, the Prize is deemed to be forfeited by that Winner and the Promoter reserves the right to conduct a redraw immediately to select a new Winner on the same basis as specified in clauses 6 and 7.
(d) Prizes will be transferred to the Winners on the day of the event.
(e) To the maximum extent permitted by law the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, the Promoter may modify, cancel, terminate or suspend the Competition.
8. Use of personal information
(a) Personal information including the Eligible Entrant’s name, address, telephone number and email, will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and the Promoter’s agents or third-party service providers, for the purpose of conducting the Competition, or for promotional and marketing purposes (including for direct marketing) (Purpose).
(b) By entering this Competition, Eligible Entrants consent to the use of their personal information for the Purpose, and that the Promoter may contact them for future marketing and material purposes without payment. Eligible Entrants agree that the Promoter may use this information for that purpose.
(c) Eligible Entrants may access, change or update their personal information by emailing the Promoter on younited@diabetesaustralia.com.au or by telephone at 1800 177 055 during office hours. A copy of the Promoter’s privacy policy is available at www.diabetesaustralia.com.au/privacy-policy/. The privacy policy contains information about how individuals may access or correct personal information or make a privacy-related complaint.
9. Intellectual Property
(a) By entering this Competition, Eligible Entrants license the Promoter to use the content of their entry in any way the Promoter wishes (including modifying, adapting, copying, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media in perpetuity without payment to the Eligible Entrant of royalties or compensation.
(b) By entering this Competition, Eligible Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Eligible Entrants’ moral rights and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.
(c) Eligible Entrants warrant that their entry is not in breach of any third party intellectual property rights.
10. Publicity
Eligible Entrants consent to the Promoter using their name, likeness, image or voice (or a combination of these) in the event that they are a Winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Competition (including any outcome) and/or promoting any products manufactured, distributed or supplied (or both) by the Promoter.
11. Governing law
These terms and conditions, and the trade promotion and any claim or dispute between the Promoter and an Entrant are governed by the laws of Queensland, Australia. Entrants submit to the non-exclusive jurisdiction of courts and tribunals of that State in connection with any dispute concerning these terms and conditions or the Competition.
12. General provisions
(a) The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
(b) Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a Prize should be directed to the Promoter. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details.
(c) The Promoter reserves the right to request verification of the Winner and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.
(d) The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Competition, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. In the event that a Winner breaches these terms and conditions, the Winner will forfeit the Prize in whole and no substitute will be offered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
(e) The Winners may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way.
However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation:
(i) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(ii) any theft, unauthorised access or third-party interference;
(iii) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(iv) any variation in market value to that stated in these terms and conditions;
(v) any tax implications; or
(vi) the Prize or use of the Prize.
(f) If for any reason beyond the reasonable control of the Promoter this Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, unless to do so would be prohibited by law.
(g) The Promoter reserves the right to cancel, terminate, modify or suspend the Competition or amend these terms and conditions, subject to any directions from a regulatory authority.
